Terms and Conditions 7th April 2009
By placing an order you are agreeing to the terms and conditions of World Class Stallions (WCS). All orders are subject to these terms and conditions which can only be varied by written agreement from a Director of WCS.

No guarantee of pregnancy is given by WCS under any circumstances whatsoever.

We will not be liable for any loss of income, loss of profits, loss of reputation, loss of custom, loss of use, loss of an opportunity or for any indirect, incidental, special or consequential damages or loss howsoever arising including but not limited to the unsuccessful insemination of a mare.

Customers are presumed to have understood and/or read all information and advice imparted verbally or in writing by WCS.

WCS uses reasonable endeavors to ensure that all information and advice given to its customers is accurate. However, WCS cannot accept liability for any incorrect information. Customers are advised to verify the accuracy of all information themselves and to discuss all issues with their veterinary as appropriate.

WCS will use reasonable endeavors to resolve any disputes relating to the quality or other properties of any semen, but liability for semen rests solely with the relevant stud.

Semen advertised by WCS may be unavailable at times without notice. WCS will in these circumstances use reasonable endeavors to provide semen in exchange (of the same value or a lesser value to that ordered). If we are unable to supply a suitable exchange, the mare may be required to miss a cycle or a refund may be given if no semen has yet been delivered under the order.

We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website (see date at the top) and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.

If you are not the customer, WCS will require you to confirm that you have the authority to bind any business on whose behalf you place an order.

Frozen Semen

Stallions are sold under October 1st terms. Up to 3 (three) doses of semen are allocated per mare to obtain a pregnancy. Once a pregnancy is obtained the remaining doses of semen are returned to the storage centre at Towcester. If the mare is not in-foal on the 1st October (latest date) of the breeding year, 50% of the covering fee will be credited to your WCS account on receipt of the signed insemination certificate provided by WCS.

Certain stallions including the Schockemöhle stallions are available for purchase on a per dose basis.

Chilled Semen

Stallions are sold under the terms and conditions applicable to the stud used. Please contact the office for further information on individual stallions.

Sales

No semen will be dispatched without the receipt of a completed 2009 order form and full payment.

All invoices will be issued in Euros and will be required to be paid in Euros by the customer.

Interest at the rate of 2% per day will be charged on overdue accounts.

We understand and will exercise our statutory right to interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to agreed credit terms.

Where applicable, VAT will be charged at 15% (or the prevailing rate at the time of order).

Payment may be made by direct bank transfer or cheque for which there will be no charge.

Payment may be made by online debit card or credit card for which there will be no charge.

All prices and terms and the availability of stallions are subject to change. The Customer must confirm the details of an order with WCS immediately prior to ordering and payment.

It is the client’s responsibility to ensure WCS have insemination dates before the 1st October for any mare inseminated for covering certificates.

Delivery

WCS accepts no liability for the time of delivery of semen. Although the transport couriers endeavor to deliver in accordance with timed deliveries, they do not guarantee a timed delivery. As such, neither the transport companies nor WCS provide any compensation for any loss or costs arising from late delivery of semen.
We will not be liable for any loss of income, loss of profits, loss of reputation, loss of customers, loss of use, loss of an opportunity or for any indirect, incidental, special or consequential damages or loss howsoever arising including but not limited to the loss, damage, delay, mis-delivery or non-delivery of your shipment.

Delivery for Frozen Semen

Semen is not insured once it has been dispatched from the distribution centre. Please speak with your veterinarian to check if it is insured while stored with them. WCS accepts no liability for the semen once it has been delivered.

Delivery will be charged at £80 plus VAT for the first two doses and thereafter a subsequent £80 plus VAT for the delivery of the third dose (or the actual delivery cost + 20% administration should delivery costs increase). We require notice for delivery of the third dose. This price includes Health Certificates required by the vets. Delivery must be paid for in full prior to any semen being dispatched.

Delivery of semen for a stallion which is arranged by special request of the customer will be subject to costs and VAT as specified at the time of order and will be payable in full in Euros prior to any semen being dispatched.

Delivery for Chilled Semen

Semen will be charged according to courier charges for individuals, these may range for a standard delivery from £60-100 plus VAT and invoiced directly to the client.

Chilled semen can only be delivered Tuesday to Friday inclusive. Saturday deliveries are possible but there will be an additional charge. (Please enquire in the office regarding Saturday delivery and prices).

48 hours notice is required for the order of each dose of chilled semen.

An extra charge of between £20-£45 (at the equivalent rate in Euros) is made on each dose of chilled semen ordered, depending on the stud. This is to cover health certificate charges required by the vets and full payment must be made before semen is dispatched.

Miscellaneous Provisions

The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract.

If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.

No delay or failure by WCS to exercise any powers, rights or remedies under these terms and conditions will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing and signed by an authorised representative of WCS.
